  1. Your insurance policy is a LEGAL CONTRACT.  The LAW OF CONTRACT requires a person of business to fulfill any legal obligation they have voluntarily assumed by the contract.  Your policy outlines the positions of the two parties to the contract, and provides a procedure that the parties will be governed by should a loss occur.

  2. You have the right to choose your own contractor.  Your contractor will be working directly for you & NOT YOUR INSURANCE COMPANY.  Your insurance company cannot specify which contractor you hire, nor does the insurance company guarantee the performance of any firm you hire.  It is in your best interest to utilize the services of an experienced professional whom you trust and feel comfortable working with.

  3. You are required to take emergency steps to minimize the loss.  Board-up the premises, removal of water, structural drying, deodorization, restoration of utility services, etc.  Failure to preserve and protect your property may  jeopardize your insurance claim. 

  4. You have the right to an accurate scope of repairs prepared by the contractor of your choice. Experienced restoration contractors know where to search for damage, which may not be apparent to builders, remodelers, etc., inexperienced with restoration.  The scope should be a detailed, FULLY ITEMIZED listing of costs to restore your property to a level equivalent to its pre-lost condition, with equal quality.

  5. You have the right to know where you stand from the coverage aspect.  Do you have enough coverage?  Will depreciation be taken?  Depreciation is taken away from current cost.

  6. You have a right to an agreed price before the work is performed.  The agreed price reflects the scope of damage and repairs, and the price your insurance company is agreeing to pay to have the work performed.

  7. Nowhere in your insurance policy do the words competitive bid, cheapest, or lowest price appear.  Your contractor’s rates should reflect the prevailing rate for first class workmanship and materials.  It is to your advantage to have a single JUSTIFIABLY, ACCURATE estimate prepared by a contractor whose judgment you trust, rather than complicating matters with competitive bids, freeing your insurance carrier to pay the lowest bid!

  8. If substantial disagreement arises between you and your insurance company which cannot be resolved, you are entitled to request arbitration or appraisal.

  9. You are entitled to received payment within the terms of your policy; a procedure which prevents your insurance company from utilizing time and hardship to force a lower settlement.

  10.
